Applicable Law. This site is created and controlled by The Bank of Spring Valley in the State of Wisconsin, USA. We reserve the right to make changes to our site and these disclaimers, terms, and conditions at any time.
Hardware, Software and World Wide Web Connection.
You understand and agree that you may access the Services by electronic transmission to our host server (the “Server”) on the World Wide Web (“WWW”) portion of the Internet. In order to utilize this service you will be required to provide all hardware, software and a WWW connection. Typically, this will be a personal computer, Internet browser and Internet service provider.
Availability. You may access an Eligible Account at the The Bank of Spring Valley Web site at
www.BankofSpringValley.com to obtain balances, transaction history and other information. Subject to the terms of this Agreement, you will generally be able to access your Eligible Accounts through the Web site 7 days a week, 24 hours-a-day. A transfer completed through a Service before the transfer cutoff time on a business day will be posted to your Eligible Account the same day. All transfers completed after the transfer cutoff time on a business day or on a day that is not a business day, will be posted on the next business day. The transfer cutoff time is 3:00 p.m. (Central Time). Every day is a business day except Saturdays, Sundays and Credit Union holidays.
Alternative Access. At certain times, a Service may not be available due to system maintenance or circumstances beyond our control. During these times, you may use The Bank of Spring Valley automated teller machine ("ATM"), call 715-778-5537 during regular business hours, or come to one of our The Bank of Spring Valley offices to obtain information about your Eligible accounts.
IV. Eligible Accounts
Your Eligible Accounts will continue to be subject to the agreements otherwise governing them, except where it is noted in this Agreement. Additionally, each Eligible Account and Internet Banking Service will be subject to the following: the terms or instructions appearing on a screen when using a Service;
The Bank of Spring Valley’s rules, procedures and policies applicable to each Eligible Account and each Internet Banking Service;
the rules and regulations of any funds transfer system used in connection with an Internet Banking Service;
and
applicable state and federal laws and regulations.
Processing of Transfer Requests.
Transfers may be made to any linked Eligible Account from any linked Eligible Account.
Transfers may be made as a payment to a linked loan account. By initiating a transfer, you are authorizing The Bank of Spring Valley to debit an Eligible Account in the amount submitted and credit an Eligible Account in like amount. The completion of a transfer is subject to the availability of sufficient funds at the time of processing. You agree that you will initiate a transfer from an Eligible Account only when the account has a sufficient balance for the transfer, including any available funds covered under an overdraft protection plan. If sufficient funds are not available, we may refuse to complete the transaction. In addition, you may incur an insufficient funds fee as disclosed to you in other account documents provided at, or subsequent to, account opening. The Bank of Spring Valley is under no obligation to notify you if it does not complete a transfer because there are not sufficient funds in your account to process the transaction. Processing of Bill Payment Requests. Payments may be scheduled from checking accounts and can be entered as a one-time transaction or as a recurring transaction. By initiating a transfer, you are authorizing The Bank of Spring Valley to debit an Eligible Account in the amount submitted and transmit a payment on your behalf in like amount. The completion of a payment is subject to the availability of sufficient funds at the time of processing. You agree that you will initiate a payment from an Eligible Account only when the account has a sufficient balance for the payment, including any available funds covered under an overdraft protection plan. If sufficient funds are not available, we may refuse to complete the transaction. In addition, you may incur an insufficient funds fee as disclosed to you in other account documents provided at, or subsequent to, account opening. The Bank of Spring Valley is under no obligation to notify you if it does not complete a payment because there are not sufficient funds in your account to process the transaction. Electronic Transmission - Most payments may be made by electronic submission, with over 3,000 payees
(vendors/merchants) accepting payment via electronic transmission. If a payee does not accept electronic transmission, you
may contact The Bank of Spring Valley to request the payee be added to the listing of electronic payees. There is no
guarantee that the payee will elect to receive payment via electronic transmission and The Bank of Spring Valley has no
control over their decision in this matter. However, every effort will be made to enlist the payee to accept electronic
payment.
Check: Payees not accepting electronic transmission will be paid with a check within 7 - 10 business days of online authorization.
Downloading to Financial Software. Your account information may be downloaded to financial management software, such as
Quicken® or Microsoft Money®.
VII. Linked Eligible Accounts
enter into this Agreement, as amended from time to time;
access each Eligible Account of yours in any manner and for any purpose available through the Service, whether now or in the
use any Internet Banking Service in any manner and for any purpose available through the Service, whether now or in the future.
IX. Electronic Fund Transfer Provisions For Consumers Applicability.
The provisions in this section apply only to electronic fund transfers (an "EFT") that debit or credit a consumer’s
checking, savings or other asset account and are subject to the Federal Reserve Board’s Regulation E. The Bank of Spring Valley
may, when applicable, rely on any exceptions to the provisions in this section that are contained in Regulation E. All terms not
otherwise defined in this agreement, which are defined in Regulation E, will have the same meaning when used in this section. Your Liability. Tell us AT ONCE if you believe your card and/or code has been lost or stolen. Telephoning is the best way of
keeping your possible losses down. You could lose all the money in your account (plus your maximum overdraft line of credit). If
you tell us within 2 business days, you can lose no more than $50 if someone used your card and/or code without your
permission. (If you believe your card and/or code has been lost or stolen, and you tell us within 2 business days after you learn of the loss or
theft, you can lose no more than $50 if someone used your card and/or code without your permission.) Telephone Number and Address. If you believe your card and/or code has been lost or stolen or that someone has transferred or may transfer money from your account without your permission, call or write us at the numbers and address listed below: Error Resolution Notice. In case of errors or questions about your electronic transfers, call or write us at the telephone number or address listed in Section C above as soon as you can, if you think your statement or receipt is wrong or if you need more information about a transfer listed on the statement or receipt. We must hear from you no later than 60 days after we sent the FIRST
statement on which the problem or error appeared: Tell us your name and account number (if any).
Describe the error or the transfer you are unsure about, and explain as clearly as you can why you believe it is an error or
why you need more information.
Tell us the dollar amount of the suspected error.
If you tell us orally, we may require that you send us your complaint or
question in writing within 10 business days. X.Your Ability to Withdraw Funds.
This policy statement applies to all deposit accounts. XI. Security
User Name and Password. A User Name will be assigned at time of application for the Service. The User Name will be used each time you log in. You will also be assigned a default password when your online account is setup. The first time you login, using the default password, you will be required to set a new password. You acknowledge and agree that your password, when used in connection with the Services, identifies and authenticates the user of the Services, has the same legal effect as your signature, will be relied upon by The Bank of Spring Valley and shall constitute your authorization to complete the transactions affecting your accounts initiated through the use of the Services. You agree that your password is personal and confidential, that your password is a security method used by us to help you maintain the security of your accounts and that you will take reasonable precautions to protect the confidentiality of your password, including not disclosing your password to any other person. If you believe that your password may have been lost or stolen, or that someone has transferred or may transfer money from your account without your permission, or if you suspect any fraudulent activity on your account, notify The Bank of Spring Valley immediately at 715-778-5537 or at our address, listed elsewhere in this agreement. Browsers/Virus Protection. In order to take advantage of the security features of Internet Banking, you must use Microsoft Internet Explorer 5.5 or higher or Netscape 6.2.3 or higher, with 128-bit encryption support. Use of anti-virus software is strongly recommended. If your computer becomes infected with a virus, you could possibly lose information. We recommend that you use an anti-virus program that automatically upgrades your virus protection on a recurring basis. If you do not have an automatic upgrade feature, we recommend that you update your virus detection program on a weekly basis and when you hear of a new virus. Avoiding ID Theft on the Internet. Although The Bank of Spring Valley takes every possible measure to protect your information, you, also, play a major role in protecting your personal information.
XII. Liability
IN NO EVENT WILL WE HAVE LIABILITY FOR ANY CONSEQUENTIAL, SPECIAL, PUNITIVE OR INDIRECT LOSS OR DAMAGE WHETHER OR NOT ANY CLAIM FOR SUCH DAMAGES IS BASED ON TORT OR CONTRACT OR WE KNEW OR SHOULD HAVE KNOWN THE LIKELIHOOD OF SUCH DAMAGES IN ANY CIRCUMSTANCES. We will not be obligated to honor, in whole or in part, any transaction or instruction which:
involves funds subject to a hold, dispute, restriction or legal process we believe prevents their withdrawal; would result in us exceeding any limitation of our intra-day net funds positions established pursuant to present or future Federal Reserve guidelines; would violate any applicable provision of any risk control program of the Federal Reserve or any applicable rule or regulation of any other federal or state regulatory authority; is not in accordance with any other requirement of our applicable policies, procedures or practices; or we have reasonable cause not to honor for our or your protection. governs your Eligible Account, if you are an owner of an Eligible Account, you agree to indemnify and hold us, our directors, officers, employees and agents harmless from all loss, liability, claims, demands, judgments and expenses arising out of or in any way connected with an Eligible Account or the performance of an Internet Banking Service. This indemnification is provided without regard to whether our claim for indemnification is due to the use of the Service by you or your authorized representative. Third Parties. Except as specifically provided in this Agreement or where applicable law requires a different result, neither we nor our service providers or other agents will be liable for any loss or liability resulting in whole or in part from any act or failure to act of your equipment or software, or that of an Internet browser provider such as Netscape (Netscape Navigator Browser) or Microsoft (Microsoft Explorer Browser), by an Internet access provider, by an online service provider or by an agent or subcontractor of any of them, nor will we or our service providers or other agents be responsible for any direct, indirect, special or consequential, economic or other damages arising in any way out of your access to, use of or failure to obtain access to Internet Banking Services through the Service. XIII. General Provisions

If you wish to cancel any of your Internet Banking Services, contact The Bank of Spring Valley at 715-778-5537 or send us cancellation instructions in writing to: The Bank of Spring Valley Changes. Except as otherwise required by law, rule or regulation, we may change the terms of this Agreement from time to time and at any time. When changes are made we will update this Agreement at www.BankofSpringValley.com. The Web site will be updated on the effective date, unless an immediate change is necessary to maintain security of the system or unless a law, rule or regulation requires that it be updated at an earlier time. As always, you may choose to accept or decline changes by continuing or discontinuing to use the Service. Disclosure of Information. The circumstances under which we will disclose information about you, your Eligible Accounts or your Internet Banking Services is set forth in the information that has been separately disclosed to you in the contracts, notices and disclosures that have been separately provided to you in accordance with our policy disclosed at our Web site.
